I wouldn't necessarily say the shadow cloaker has to be Evil, jundging by the description; it's not as if it chose to be parasitic in its biology. I'd be more inclined to call it an "Often evil" than a "Usually" or "Always", as that makes it a bit more useful as a monster: most shadow cloakers would be antagonists for PCs, but occasionally a Neutral one might crop up working for the same side as the heroes.

Note that a lack of true compassion need not rule out Good alignments, altogether. A shadow cloaker wouldn't adhere to Good standards out of sympathy for its host, but it might make the intellectual decision to adopt a moral code, acting upon reason rather than emotion. Extremely unlikely, but it's at least possible: not all Good creatures are governed by empathy.

Well this particular cloaker has been charmed prior to being attached to a certain Jacob person. So it would be quite helpful towards him or his master. (Depends on who cast the charm and what instructions were given)

Later it was taken by a PC and donned like a simple cloak.

Taken accidentally. Tessius wasn't trying to steal said cloaker. He was just trying to get rid of Jacob's allies, and he knew the cloak was intellegent. That it attached itself to him was a surprise, and he just hasn't really had the time to try to get rid of the thing yet.
